Freehold Workers Compensation Lawyer
Dedicated Freehold Workers Compensation Lawyer Guides Injured Workers After On-The-Job Accidents in Monmouth County and Across NJ
Sustaining a work injury or occupational illness can have devastating impacts on your whole life. You may need to undergo weeks or months of medical recovery, during which you may sustain a loss or reduction of income if you cannot work. Even once you’ve finished treating your injury or illness, you may experience permanent disabilities that restrict your ability to return to gainful employment. To help mitigate the impacts of a work injury or occupational illness, New Jersey’s workers’ compensation system entitles those who have suffered a work-related injury or illness to certain defined financial benefits. But not all workers have an easy time getting the benefits they need and deserve. If you are having trouble getting workers’ comp benefits from your employer, turn to a Freehold workers compensation lawyer for help.

What Can You Get From Workers’ Compensation?
In a workers’ comp claim, you may be entitled to receive financial benefits from your employer or its workers’ compensation insurer. Benefits available from workers’ comp in New Jersey include:
- Medical benefits, which cover the cost of treatment, rehabilitation, and pain management for a work injury or occupational illness
- Temporary disability benefits, which provide partial wage replacement if a worker cannot work or experiences reduced income while recovering from a work-related injury or illness
- Permanent partial disability benefits, which provide financial payments based on the workers’ pre-injury wages and the type and severity of their disability
- Permanent total disability benefits, available when a worker cannot do any form of gainful employment, which continue paying partial wage replacement for as long as the worker is totally disabled
- Death benefits, which offer financial payments to immediate family members of a deceased worker whose death resulted from a work injury or occupational illness
Filing a Workers’ Comp Claim After a Workplace Accident in Freehold, NJ
To file a workers’ compensation claim after being injured in an accident at work, you must first notify your employer of your work injury. Notice can be given orally or in writing, to a supervisor or manager or any other person in an authority position with your employer, such as an HR representative. State workers’ compensation law requires you to give notice of a work injury to your employer promptly, which normally means within 14 days of the date of your injury, to receive benefits from the date of injury. However, notice typically must be given no later than 90 days after a work injury to maintain eligibility for workers’ compensation.
When you give your employer notice of your work injury, your employer or its insurer is obligated to file a first report of injury with the New Jersey Division of Workers’ Compensation. You must then file a written claim petition within two years of the date of your injury or last payment of benefits. A claim petition allows you to obtain an informal or formal hearing before a workers’ compensation judge to either try to resolve your claim with your employer or to obtain a binding ruling from the judge on your claim. A claim petition also allows you to collect financial compensation for your permanent disability or injury.
