Benefits Recoverable for Knee Injuries
To recover workers’ compensation benefits, the claimant must be an employee who was injured during the course and scope of his or her employment. Depending on the nature of the injury, the employer may attempt to argue that the injury was caused by a preexisting condition or factors outside the workplace. When it has been established that the injury is work-related, the injured person may be able to recover both medical benefits and income benefits. Treatment may include surgery, hospitalization, prescriptions, therapy, and assistive devices. In most cases, the employer is permitted to choose the treating physician. Any treatment in excess of $50 must be proven to be necessary, and the cost of the treatment must be shown to be reasonable.
Employees who are unable to work for more than seven days due to work-related injuries are eligible to receive temporary total disability benefits. The benefits are paid at a rate of 70% of the employee’s weekly wage but cannot exceed a defined maximum or fall below a defined minimum. The benefits will be paid until the employee returns to work or reaches maximum medical improvement.
